California State Proposition 76:
-
Limits state spending to prior year’s level plus three
previous years’ average revenue growth.
- Changes state minimum school funding requirements
(Proposition 98); eliminates repayment requirement when minimum funding
suspended .

Excludes appropriations above the minimum from schools’ funding base.

A YES vote on this measure means: State expenditures would be subject to an additional spending limit based on an average of recent revenue growth. The Governor would be granted new authority to unilaterally reduce state spending during certain fiscal situations. School and community college spending would be more subject to annual budget decisions and less affected by a constitutional funding guarantee.
A NO vote on this measure means: The state would not adopt an additional spending limit, the Governor would not be granted new powers to reduce state spending during certain fiscal situations, and existing constitutional provisions relating to schools and community college funding would not be changed.

Luther Jackson is a member of the First Unitarian Church of San Jose and chairs The Interfaith Council on Religion, Race, Economic and Social Justice in Santa Clara County.
I recently attended a meeting of California economic justice faith activists and participated in a discussion about Proposition 76, the complex measure that would turn the state budget process on its head.
As participants talked about spending caps and school funding formulas, I found myself reverting to the journalistic training I received as a reporter at the Detroit Free Press.
Rather than wallow too much in the details, I think it’s important to cut through the thick bureaucratic swamp and clearly focus on the bare essence of any issue.
Proposition 76 represents a major attack on state government. It would take $4 billion from our schools and hurt the state’s ability to respond fiscally to the needs of our growing population.
By putting much more power in the hands of the Governor, Proposition 76 undermines our citizens’ democratic rights to lend their voices to debates on spending priorities and the moral principles that underlie those budgetary decisions.
And who in our state are most reliant on the services provided by state government?
The poor, our children, the elderly and the disabled.
Once we have framed Proposition 76 as an attack on our most vulnerable citizens and their right to lend their voices to a democratic debate, we are able to view this initiative through the lens of our cherished UU principles.
As people who covenant to affirm and promote; the inherent worth and dignity of each person and justice, equity and compassion in human relations and the rights of conscience and the use of the democratic process within our congregations and in society at large, I believe we are called to stand against any threats to what we hold dear.
There may be some UUs who feel that our sanctuaries are inappropriate places to discuss ballot box issues.
But there are strong voices from our faith tradition and others who suggest we not shy away from the public arena.
In his book “Forward Through the Ages,” the Rev. Dr. Dana Greeley – first UUA president says:
“There is a separation of church and state, but there cannot be a separation of religion and politics. The church must be the conscience of the state. … The major mistake of any church is to make religion only ceremonial and otherworldly and keep it separated from society and everyday affairs.”
The Rev. Dr. Martin Luther King Jr. said:
“Power without love is reckless and abusive and love without power is sentimental and anemic. Power at its best is love implementing the demands of justice and justice at its best is power correcting everything that stands against love.”
We have an opportunity on November 8 to bring our UU love out of our churches and into the voting booths and help build a powerful progressive movement in California that lifts up all of our citizens.

Proposition 76 is another step in achieving the Ultra Conservative dream of eliminating government and privatizing everything. This attack is particularly on public schools. If conservatives can squeeze the money and viability out of public schools, it makes private schools and the voucher system more viable.
It gives the Governor in certain times extraordinary power and control over the budget. When the governor declares a crisis, they can then cut what ever items they want, even those contractually obligated. A governor with this power will be able to wheel and deal to get any legislation passed that they want.
By holding budgets to the past year when the budget doesn't pass the legislature, we in effect reduce spending and cut funds from critical programs since budgets for all programs need to increase to compensate for inflation and growth. Coupled with the super majority requirement of a 2/3rds vote to pass budget items, it give the 1/3rd of the legislature the ability to stop budget approval and hold the budget at last years levels. This gives even more power to the republican minority to shrink our state government.
We pass Prop 98 to increase school funding. The Governor and the Legislature have borrowed funds the voters dictated to support schools and this proposition will allow them to not repay those borrowed funds and will not allow the re-establishment of the levels approved by the voters when they passed 98.
The way to balance the budget is to increase taxes, especially on the very rich. It wouldn't take more than a one or two percent increase in taxes for the wealthy to balance our budget. But as long as the super majority rule allows republicans to vote down any tax increase, we will never be able to balance the budget without making substantial cuts to schools, Medicare, Medi-Cal and other programs designed to make this a just society.

First, as a DRE I encourage you all to vote. It is great modeling behavior of Unitarian Universalist Principles for our children and youth.
Secondly, I have deep concerns regarding prop 76. It is a deeply flawed stab at reforming Califonia. However,it neither addresses California's educational needs nor does it help to fix California's continual structural deficit issues. It is complex legislation which only hurts the few remaining programs we have left in our public schools. It also (and this is the part that really concerns me)gives ultimate power to one person. The governor. Despite how one might feel about the current governor, we must also think about the future. Where will we be in five or ten years? Who will the governor be then? Do we want to give up the checks and balances system which allows us to take an active role in government? Instead of hurting our educational system, we must focus on bringing California schools into the 21st century both in programming and funding. Proposition 76 if passed will be detrimental to the future of our children, their education and their role in the future of California.

When the governor "borrowed" $2 billion from education, it put school districts in a difficult position. School districts were obligated to pay their bills, including honoring labor contracts, even though our budgets where cut. School districts are still feeling the pain. Proposition 76 would allow a governor to cut funding anytime; it is almost impossible to budget if you can't count on what you will be receiving. Also, the idea of giving one person, the governor, power to cut funds without going through the legislature is very un-American. We have a system of checks and balances in our political system. Propositon 76 removes the legislature from the process. I realize that many people blame the legislature for many of our budget problems but this brings up the point of learning about candidates and voting. Giving the power to one person to make budget decisions is a bad idea.

This extremely complex measure gives the governor authority to declare a
"fiscal crisis" at any time of the year, giving him the power to cancel
employee contracts, circumvent proposition 98 (mandated minimal funding
for education), and slash up previously arrived at budget appropriations
at will. The measure also limits state spending to the prior year's level
plus an average of three years revenue growth. It would lock in the prior
year's appropriations in the event that a budget is not reached (curiously
without reference to whether revenues match the previous year). It would
prohibit borrowing from state special funds (except of course prop 98
mandated funding). And thrown in as a bone to local governments who will
have to take up the slack for more state funding limitations, the measure
prohibits unfunded mandates.
On my radio show, San Francisco Bay Guardian editor Tim Redmond referred
to this measure as "the most profound power grab attempt I have seen in 25
years of political reporting." As I hadn't really had time to review the
propositions in detail, I thought he was being a bit melodramatic until I
opened up the voters guide. In addition to hand-cuffing the legislature by
greatly reducing the flexibility for deficit spending in lean times
(except in the case of an emergency such as a major earthquake), the power
given to the governor to declare a "fiscal crisis" is enormous. And again,
a major target of the measure is education. For all practical purposes, it
repeals proposition 98. It provides a strict formula for the allocation of
excess revenues.
But for the politics, I would probably urge a "no" vote simply because it
is extremely complex and the public would be better served by a
legislature taking it up with the appropriate committees, hearings, etc.
Apparently they were unwilling, so Schwarzenegger wants to slip it by the
voters with simplistic packaging. The legislative analysis is almost as
convoluted and difficult to understand as the proposed text of the law
itself, but the provision of the analysis to note is the "fiscal
emergency" paragraph on page 25 of the voter's guide. It describes in
understatement (damn Kevin Shelley for wigging out and leaving us with a
Republican Secretary of State to draft the voters guide!) the scariest
provision is located in the text of proposed laws on page 61 of the
voter's guide containing subsection "g." The decision to declare
essentially a fiscal marshal law can be arrived at based upon the
governor's own fiscal estimates rather than the legislature's or that of
any other constitutional office. Secondly, the governor may unilaterally
reduce spending when an agreement "cannot be reached." And as far as I can
tell, there is no provision that would punish the governor from cooking
his projections, even if he could be caught. I'd still vote against it,
but you'd think he would have the decency to at least propose a mandate
that the Treasurer's office or Controller's office produce the criteria
upon which the "fiscal emergency" is determined.
I have numerous additional reasons to oppose this draconian and convoluted
measure, but if near total power to the governor isn't enough, you won't
be convinced by anything else I have to say. I hope enough voters can see
through the simplistic ad blitz.

I confess to being pretty naive politically. Reading through the description in the voters guide and and the text of the proposed law for further clarification can still leave me confused. However, the fact that this proposition destroys our system of checks and balances and gives unlimited power to one person is enough to show me that this is bad legislation. Wheather I understand the machinations of the rest of the issue seems irrelevant in this light.
I do not believe that throwing more money at education in California is the answer to improving our schools. Education doesn't seem to be valued by a large majority of parents. It has become glorified babysitting in the eyes of many. I believe that children will do well in school when they know that it is important to their parents that they get good grades. Education is a privilege that has become something that is taken for granted and not really valued by too many parents.
We need to restructure our educational system so that motivated students get a good education and the balance are directed elsewhere until they are ready for the privilege.
